Applications for Group Admissions to The Gardens at Highgrove House
You may apply to A. G. Carrick Ltd (“us”) for tickets for admission to the Gardens at Highgrove House (defined below) open to the public, subject to the following terms and conditions:
In these conditions the following words shall have the following meanings:
"Admission" means a ticket issued by us allowing you to visit the Gardens at Highgrove House on the date (if any) and at the time (if any) stated on the ticket;
"Agent" means a travel agent, tour operator or similar commercial person to whom these Conditions apply;
"these Conditions" means these terms and conditions and the Conditions of Admission to The Gardens at Highgrove House;
"Group" means the number of people specified in the Admission consisting of a maximum of 26 or as varied pursuant to these Conditions;
"Group Admission" means an entitlement issued by us in writing allowing a Group to be admitted to The Gardens at Highgrove House on the date and at the time (if any) stated in the entitlement;
"Organiser" means a member of the Group (who is not an Agent) organising the Group's visit to The Gardens at Highgrove House;
"the Estate" means the areas of The Gardens at Highgrove House stated on the Group Admission (including its grounds and outbuildings) that are open to Visitors on the day of admission;
"Visitors" means any persons entitled to visit The Gardens at Highgrove House, whether by virtue of a Group Admission or otherwise.
2.1 All applications are made subject to these Conditions.
2.2 You may apply for Group Admissions to The Gardens at Highgrove House (during its public opening times) at any time. In relation to each Group Admission:
(a) The maximum number of visitors is 26;
(b) Any guides or couriers (who will make up the Group with the other Visitors) must be included within your application.
2.3 We accept applications subject to availability and on the basis that applications made by you are correct (unless you indicate otherwise). We shall provide you with a confirmation notice confirming the Group Admission(s).
2.4 Payment in full must be received by us 6 weeks prior to the proposed visit or on application if the application for the Group Admission has been made less than 42 days before the proposed visit.
2.5 Where payment in full is not received 42 days prior to the proposed visit or on application (if later), we shall deem your application to have been withdrawn and the Group Admission(s) cancelled.
2.6 Risk of loss of Group Admission Tickets passes to you upon purchase or on postage by us (whichever is applicable). We will make an administration charge for issuing a replacement Group Admission Tickets.
3. Admission to The Gardens at Highgrove House
3.1 A Group Admission is valid only for the date and time specified on the Group Admission Tickets. A Group will only be admitted to The Gardens at Highgrove House upon presentation of valid and correct Group Admission Tickets.
3.2 Groups arriving after any date or time specified will not be admitted unless there is availability and then only at our absolute discretion. We ask all Groups to arrive 15 minutes prior to their allotted ticket time. Groups arriving more than 15 minutes early will not be admitted.
3.3 In the event of short notice closure of the Gardens at Highgrove House on your proposed visit date, we reserve the right to cancel and refund your booking, or where possible offer an alternative visit date.
3.4 You acknowledge that all Visitors are subject to the Conditions of Admission to The Gardens at Highgrove House. You undertake to obtain and give a copy of those conditions to each Visitor.
4. Specific Access Requirements
4.1 Your visit to the Highgrove will last approximately 3½ hours, taking in the tour of the garden, resdtaurant and shop.
4.2 Some paths on the Estate are unmade, there are cobblestones on the Estate and there are no seating facilities in the garden. This should be borne in mind, especially if any members of your party have walking difficulties. Tours will continue in wet weather, and it is recommended that stout shoes and suitable clothing is worn.
4.3 Wheelchair users must bring a strong helper and notify us at the time of booking as our Health and Safety requirements limit the maximum number of wheelchair Visitors at any one time. Wheelchair users must bring their own equipment and ensure it is suitable for bumpy and unmade paths. Adverse weather conditions may restrict access to some areas of the garden for wheelchairs users and as such visitors may be required to use an alternative route. Wheelchair access is available to the restaurant and shop.
5.1 In the event of short notice closure of the Gardens at Highgrove House on your proposed visit date, we reserve the right to cancel and refund your booking, or where possible offer an alternative date.
5.2 We do not refund Group Admissions (or part cancelled) for The Gardens at Highgrove House preceding the visit or in the event of non-arrival. For the avoidance of doubt, the provisions of this clause do not affect your legal rights.
6. Sale of Group Admissions by an Organiser
If you are an Organiser, you may not without our consent sell Admissions other than to members of a Group or to members of your families. Our consent is at our own entire discretion.
7. Sale of Group Admissions by an Agent
7.1 You may sell the Group Admission only as part of a package comprising the admission and other elements such as accommodation and/or transport.
7.2 Any package which includes an admission must offer "good value for money". It should be sold for the price which the Visitor would reasonably expect to pay for a similar package. Your package must not oblige a Visitor to obtain services (including accommodation and/or transport) from a third party (other than a permitted sub-agent) unless such services are part of a package previously approved by us.
7.3 You may use a Group Admission as part of a package sold to your own customers or you may sell a Group Admission in its entirety to a sub-agent for resale to Visitors (but not for resale to further sub-agents). You must, on request, provide us with details (including address, telephone and fax numbers and email address) of any sub-agent, and the terms on which such sale is to be made.
7.4 We reserve the right to require you to supply for our approval your promotional/marketing material relating to your packages which include admission to any Residence.
8. Responsibilities of Group Organisers
8.1 Group organisers are required to ensure that all members of your group (including the coach driver) are all made fully aware of the security information prior to your visit.
8.2 Group organisers are responsible for the conduct, health and welfare of your group and to ensure the group stays together whilst they are visiting the Estate. This condition is detailed within the Group Leader's Declaration which needs to be signed and presented on arrival. Highgrove Enterprises reserves the right to prohibit entry to the gardens if a Group Leader's Declaration or guest list is not supplied.
8.3 Group organisers must provide a full list of visitors in your group on the day of your visit on arrival.
8.4 Group organisers must ensure security protocols are followed (see “Security” below) and to ensure that all members of your group and coach driver are made aware of them prior to your visit.
9.1 All visitors must bring their admittance ticket and some form of photographic identification with them - ideally a passport or driving licence, bus pass (alternatively two utility bills).
9.2 Coach drivers should either stay with their vehicle or take a seat in the restaurant.
9.3 Mobile phones are not permitted to be used anywhere on the Estate. Visitors should contact a member of staff in the event of needing to make a telephone call during their visit.
9.4 No photography, binoculars or any form of recording equipment are allowed on the Estate.
9.5 Smoking is strictly prohibited on the Estate.
10. Cancellation/termination by us
10.1 If you breach any of these Conditions, we are entitled to cancel your Group Admissions immediately and without incurring any liability to you or your customers.
10.2 We are also entitled to cancel your Group Admission immediately if you cannot pay your debts or go into liquidation or there is a meeting of your creditors or if a receiver, administrator or administrative receiver is appointed over your assets, or if equivalent events occur under the laws of any country applicable to your business.
10.3 In the event that the agreement between us is terminated for whatever reason we will be entitled to the payment of any sums due to us that would have been payable by you had the agreement not been terminated.
Our prices for Group Admission vary from year to year. Our current prices can be obtained from the Ticket Sales and Information Office on 020 7766 7310 or from our website www.highgrovegardens.com. Children under the age of 5 are admitted free of charge.
12.1 Except in respect of liability for death, personal injury or other liability caused by our negligence or that of our employees, we exclude liability for loss or damage suffered as a result of your visit by you or any Visitor or occurring to any items belonging to you or to any Visitor, which is not reasonably foreseeable. If we become liable, our liability to you is limited to the price of the relevant Group Admission(s).
12.2 We will not be liable for any breaches or delays arising from any event outside our control, including (but not limited to) fire, flood, storm, strikes, riots, civil commotion, national disaster, war or acts of governmental or parliamentary authority.
12.3 The Group Admission is personal to you and may not be assigned, transferred or re-sold in any manner whatsoever other than in accordance with these Conditions.
12.4 These Conditions apply to all Group Admissions granted to you and supersede any earlier Conditions and all terms and conditions applying to previous years. All other terms and conditions whether express or implied are hereby excluded. The Conditions may not be waived or amended without our written consent.
12.5 These Conditions shall not be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person that is not a party to them.
13. Data Protection
We have notified the Information Commissioner under, and will process your data in accordance with, the Data Protection Act 1998. By sending us or our agents any messages or correspondence or by otherwise providing us or our agents with any personal data you consent to the processing of such personal data using databases and spreadsheets for the purpose of processing your request. This may involve our disclosing the personal data to regulatory bodies and/or third parties to enable any such processing to be carried out.
These Conditions shall be construed solely in accordance with the laws of England. Any disputes arising from these Conditions shall be subject to the non-exclusive jurisdiction of the courts of the England.
